Regulation 4320-SC – Sick Leave Pool

The purpose of the sick leave pool is to furnish a continuing income for members who are faced with major illness or accident. A member is defined as an employee of the school district who is employed at least .5 (full time equivalent). This pool is not designated for brief absences or for family illness, death or business.
The pool is voluntary with a cut-off date for joining of September 15 of each year.
During the first year of membership each member shall donate 2 of their leave days from that school year to the pool.
After a member’s first year, one leave day from that school year shall be donated to the pool each year until the pool has at least 250 days.
If during the school year, the pool gets as low as 125 days, every member having four or more accumulated leave days from that school year shall donate one leave day from that school year to the pool. Any member not having four or more leave days from the current school year at that time will make up the debt the following year.
Members must use 10 leave days before applying in writing to the pool administrative committee to use days from the pool. If the member does not have 10 leave days available at that time of extended illness, then the member must use all of the leave days the member does have before applying in writing to the pool administrative committee to use days from the pool.
Pool days may only be used for an extended illness or accident recovery of 5 or more consecutive school days. A written statement shall be submitted by a physician stating the nature of the illness or ailment and the inability to work because of such illness or ailment. The administrative committee shall maintain the right to require an examination by a physician of its choice.
Pregnancy is not covered by the pool except in the case of a physician determined physical inability to work during the 3rd trimester of pregnancy. Physical complications, verified by a physician, that continue after the first 6 weeks following delivery will also be covered; the first 6 weeks after delivery will otherwise not be covered.
A member can draw from the pool the designated number of days only during the current year of membership. Each year, the sick pool must be rejoined.
A member drawing from the pool shall not repay the pool.
Days donated to the pool are not recoverable and are considered “used” leave days per Policy 4310.
Termination of a member’s services in the district automatically terminates membership in the sick leave pool.
Members who have met all requirements and have completed the designated employment period in the Scott City R-1 School District may draw from the pool as follows:
- Beginning first-year members may draw up to 20 days.
- Members who are beginning their second year of membership- 30 days.
- Members who are beginning their third year of membership – 60 days.
- Members who are beginning their fourth year of membership – 90 days.
- Members who are beginning their fifth year or more of membership – 140 days.
When an employee qualifies for long-term disability, through Social Security and/or retirement, or is on leave of absence, eligibility for benefits under this policy will cease.
An administrative committee of six members will be elected by the membership of the pool to serve six-year terms. The initial committee will serve on a declining 6-5-4-3-2-1 year basis. The chairperson of the committee shall be its senior member and will be a non-voting member. If 2 or more committee members have served the committee the same amount of time, the committee shall decide by a vote which member shall chair the committee.
Administrative Committee Responsibilities
- Review all applications for pool use.
- Keep an up-to-date list of current membership and the number of days available in the pool.
- Notify members when the pool needs replenishing.
- Notify the superintendent of pool assessments.
- Review the pool policies and report to the membership at the end of each school year.
